How does Compliance work?

CrewBloom maintains a strict process to ensure compliance with the US Department of Labor and the Internal Revenue Service’s classification of contractual workers. CrewBloom takes the following steps in order to attempt full compliance.

Projects

  • All CrewBloomers are classified as “independent contractors” versus “employees” and all work completed under a project is presented to contractors in a ‘project offer.’ We will provide you with a template of the Project Agreement which you shall, in turn, email or send to the designated contractor to read and know the parameters or scope of work you wish them to perform or targets they are to meet. They must sign this Project Agreement and submit it to you before commencing work.

  • Projects renew every 12 months via an electronic ‘project renewal offer’ sent to and accepted by every active Independent Contractor. We assume all projects are to renew for 12 months unless otherwise notified in writing in advance by a member of your team.

  • Project modifications can be made at any point and should be communicated in writing to our team. Project modifications require your acceptance of a modified electronic, legally-binding agreement. You must also notify the contractor of the modification so that the new objectives are properly understood.

Documentation

  • We take full ownership of the collection and submission of form w-8BEN (OMB No. 1545-1621) to the United States Department of Labor and Internal Revenue Service.

Active Hours

  • Compensating for inactive hours is associated with salaries, aligned with the employee classification, and therefore prohibited.

  • You will be invoiced and your contractors compensated for all active hours logged in our remote workforce tracking software.

  • The minimum active hour limit for any project is 40 hours. 

  • Active hour limits can be set forth for any and all projects.

  • Implementing active hours limits for your project after the initial Proposal is accepted requires a project modification document to be electronically accepted by a member of your company as well as the active Independent Contractors assigned to that project.

Compensation

  • Our hourly rates can be increased at any point throughout the project. Additional compensation can only be associated with outcomes or performance and will be classified as a bonus. "Benefits" are associated with the employee classification and therefore strictly prohibited. This includes but is not limited to paid holidays, paid vacations, paid sick leave, and any other forms of compensation given to team members classified as employees. Any additional compensation above and beyond hourly rates needs to be set forth to recognize performance. This compensation is classified as a bonus.
